Terms of Use

These Terms of Use (“Terms”) govern the legal framework for making the website and its services available by the Rêves de vie association (“the Association”) and define the conditions of access to and use of the services by the user.

Any use of the site implies the user’s full and unconditional acceptance of these Terms.

The Association reserves the right to amend these Terms unilaterally at any time.

1. Access to the site

Access to and use of the site are reserved for strictly personal purposes. The user undertakes not to use the site—nor the information or data contained on it—for commercial, political, or advertising purposes and, in particular, not for sending unsolicited e-mail.

To submit a dream as part of the call for projects, the user must create a personal account and agrees to provide truthful and accurate information.

To access the application file, the user must then log in with their username and password.

The Association shall not be held liable for any malfunction of the site or server caused by a force-majeure event, nor for any interruption or modification due to maintenance.

2. Site content and intellectual property

All trademarks, photographs, text, comments, illustrations, images (animated or not), video sequences, audio, as well as any computer applications that may be used to operate this site—and more generally all elements reproduced or used on the site—are protected under the French Intellectual Property Code.

They are the full and exclusive property of the Association or its partners. Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, without prior written permission, is strictly prohibited. The Association’s failure to initiate proceedings upon becoming aware of unauthorized use does not constitute acceptance of such use nor a waiver of legal action.

3. Site management

For the proper management of the site, the Association may, at any time:

• suspend, interrupt, or limit access to all or part of the site, or reserve access to certain parts to a specific category of users;

• delete any information that could disrupt operation or contravene national or international laws;

• suspend the site in order to carry out updates.

While the Association strives to ensure, to the best of its ability, the accuracy and timeliness of the information published on the site (and may correct content at any time without notice), it cannot guarantee the accuracy, precision, or completeness of such information.

4. Liability

The Association cannot be held liable for any failure, malfunction, difficulty, or interruption in operation that prevents access to the site or any of its features.

The user is solely responsible for their own connection equipment and undertakes to protect it—and any personal data—from Internet-borne attacks. The user is also solely responsible for the sites and data they consult.

A user who has submitted their dream must keep their username and password confidential and bears all risks related to their use.

The Association cannot be held liable in the event of legal action against the user:

• due to the user’s use of the site or any service accessible via the Internet;

• due to the user’s failure to comply with these Terms.

The Association is not liable for damage caused to the user, third parties, and/or the user’s equipment as a result of connection to—or use of—the site. The user waives any claim against the Association in this regard.

Should the Association become involved in amicable or judicial proceedings arising from the user’s use of the site, it may seek indemnification from the user for all damages, sums, judgments, and costs resulting from such proceedings.

5. Hyperlinks

The Association bears no responsibility for third-party sites that set up hyperlinks to this site.

Hyperlinks may be present on the site; clicking on them will take the user outside the Association’s site. Any information accessible via such links is not under the Association’s control, and the Association declines all responsibility for their content.

6. Applicable law

These Terms are governed by French law and subject to the jurisdiction of French courts, unless a specific attribution of jurisdiction is provided by a particular legislative or regulatory text.
